When you visit the Website/Mobile Application or make an order through the Muchtime Website/ Mobile Application, you may be asked to provide information about yourself, including your name, contact details and payment information regarding the order. When messages are posted on the website or emails and letters are sent to us, information about your usage of the Website may also be collect. All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties. Nor will any debit/credit card details be passed to third parties.

2. USE OF YOUR INFORMATION

The information that is gathered allows us to provide you with access to the relevant parts of the Website/Mobile Application and to provide the requested services. It will also allow us to bill you and to contact you where necessary concerning our services. The information we collect may also be collected so that we can administer, support, improve and develop our business, for any other purpose whether statistical or analytical and to help us prevent fraud. We may use your information to contact you and to notify you occasionally about changes or developments to the Website/Mobile Application or our services. Where you have chosen a password, which allows you to access certain parts of the Website, you are responsible for keeping this password confidential. Unfortunately, the transmission of information via the internet is not completely secure. We take appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, MunchTime cannot guarantee the security of any information that is disclosed online. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore, users are encouraged to frequently visit these sections to be updated about the changes on the website. Modifications will be effective on the day they are posted.

Terms And Conditions Of Service

Please read these terms and conditions before ordering on our site. Welcome to munchtime.ae website and our associated applications on iPhone, Android, and mobile site platforms (each our "System"). This page explains the terms and conditions for our System on which our Associate Restaurants supply Food (the “Food") to you. You agree to be bound by these terms and conditions and our terms of use policy by accessing our site and placing an order. You are also responsible for ensuring all persons who access the website through your Internet connection are aware of these terms and that they abide by them. The term "you" or "You" shall refer to any entity or person, who accesses, submits or uses any content or material to the site. If you do not accept these terms and conditions in full please do not use our System. Once the payment is made, confirmation will be sent to the client via email within 24 hours of receipt payment.

1. ABOUT US

munchtime.ae is a website operated by MunchTime LLC ("we", "us" or "MunchTime"), incorporated in Shams, Sharjah Media City, Sharjah, United Arab Emirates.

2. FOOD

All Food are subject to availability. Associate Restaurants may offer an alternative for any Food it cannot provide. MunchTime does not guarantee any of the Food sold by our Associate Restaurants are free of allergens.

3. TIMING

Factors such as how busy a restaurant is may occasionally prevent us, or our Associate Restaurants, from achieving the scheduled pickup time.

4. CANCELLATION AND REFUND POLICY

Currently customers do not have the option to cancel an order. Therefore, any order placed will be charged to you with no refund option. We accept refunds queries within the same day of receipt only if there is an issue with the restaurant being unable to complete your order. Please notify us on our email info@munchtime.ae. In such instances, we will endeavor to refund the payment. Refunds will be made onto the original mode of payment and will be processed within 10 to 45 days, depending on the issuing bank of the credit card. MunchTime alone will determine whether an order is worthy of a refund.

5. PAYMENT AND PRICE

Prices of Food on our System will vary between menus. We reserve the right to change prices at any time. You, the customer, can choose between these payment methods provided on the platforms: local debit cards and credit cards. Currently, Visa and MasterCard are accepted. We accept payments in United Arab Emirates Dirhams. Payment is made directly to MunchTime and is then passed on by MunchTime to the Associate Restaurant. We may charge you an additional fee which will be displayed to you before you complete your order.

6. OUR LIABILITY

To the extent permitted by law, MunchTime provides our System and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our System, or that it will be timely or error-free or that defects will be corrected. Subject as provided below, neither MunchTime nor any Associate Restaurant shall have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of or your inability to use our System. In the event that MunchTime or the Associate Restaurant is found to be liable to you our total aggregate liability is limited to the purchase price of the Food you have paid for in your order.

7. SEVERABILITY

If any provision of this agreement is judged to be illegal or unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Terms and Conditions. No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision

At any time MunchTime can adjust these terms by amending this page. It is your responsibility to check this page regularly to note any changes we make, as they are binding on you.

9. GOVERNING LAW

The courts in Dubai, United Arab Emirates will have jurisdiction over any claim arising from or related to, any use of our Systems. These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates. You agree that where either Restaurant or MunchTime is undertaking delivery of an Order, MunchTime is authorized to collect an additional charge for the delivery service ("Delivery Charge"). The Delivery charge may vary from order to order, which may be determined on multiple factors which shall include but not be limited to order value, distance, demand during peak hours. MunchTime will use reasonable efforts to inform you of the Delivery Charge that may apply to you, provided you will be responsible for Delivery Charge incurred for your Order regardless of your awareness of such Delivery Charge.

During any product delivery made by restaurants, if you are not available in the address specified in the system, the meals ordered by you shall not deliver to anywhere else. Within the framework of such a case, you must accept all legal responsibilities arising from ordering a meal to an address where he/she does not exist.

In the event You have provided incorrect particulars, e.g., contact number, delivery address etc., or that You were unresponsive, not reachable or unavailable for fulfillment of the services offered to You, You will not be eligible for any refunds.

Any complaint, with respect to the Order which shall include instances but not be limited to food spillage, foreign object in food, delivery of the wrong order, You will be required to share the proof of the same before any resolution can be provided.

We collect transaction details related to your use of our services, including the type of services you requested or provided, your order details, address, and delivery information, date and time the service was provided, amount charged, and payment method.

The cardholder must retain a copy of transaction records and merchant policies and rules.

You agree not to access without authority, interfere with, damage or disrupt any part of our Site or our System or any network or equipment used in the provision of our System. You will be banned from our System indefinitely if you do not comply with these terms and legal action against you (including proceedings for reimbursement of all administrative and legal costs resulting from the breach) will be taken. We may take any other appropriate action. We reserve the right to remove any material which you submit to our Site or System (“Submissions”).
